In the newly published book on "Regulatory Competition in the Digital Economy", (external link, opens in a new window) edited by Prof. Dr Michael Denga and Prof. Dr Lars Hornuf, Daniel Schnurr analyses the effects of European data regulation in his article "European Data Regulation: Between Data Protection and Free Flow of Data in a Global Digital Economy" (external link, opens in a new window).
The article deals with European data regulation in the area of tension between data protection and the commercial use of data. It shows how the EU is taking on an international pioneering role with the GDPR, but at the same time wants to utilise the economic potential of data. This leads to conflicting objectives, which are addressed in current regulations through political compromises. The article makes it clear that this balance is difficult to achieve in a global digital economy - particularly due to regulatory circumvention possibilities, distortions of competition and the risk of data protection standards being undermined if users switch to non-European services.
